Fair Use @ Copyright Act enlists four different factors to determine the use of copyright work is fair or not




The 'fair use" doctrine is a legitimate defense in cases of copyright infringement. The Copyright Act enlists four different factors to determine the use of copyright work is fair or not, but none of these factors are determinative.

First Factor @ is the purpose and the character of the use

Second Factor @ talks about the nature of the copyrighted work.

Third Factor @ talks about the amount and substantiality of the portion used in relation to the copyrighted work as a whole.

Fourth Factor @ talks about the effect of the use upon the potential market in regard to the copyrighted work.
