Other institutions eligible to accept foreign contribution without FCRA registration included the IITs, the Punjab University, and the School of Planning and Architecture.
Delhi University (DU), Jawaharlal Nehru
University (JNU) and Gujarat National Law University are among around 300
institutions in the country that can accept foreign donations without being
registered under the Foreign Contributions Regulation Act (FCRA), the MHA
officials clarified.
While these institutions were on the list of
organisations whose FCRA registration was cancelled in June, Home Ministry
sources claimed that they did not require FCRA registration in the first place
to accept foreign donations.
“If an institution is created by an Act of
Parliament or by a state legislature, or its accounts are audited by the
Comptroller and Auditor General of India (CAG), they are eligible to accept
foreign contribution without registration under FCRA,” the official said. As per
the Gazette Notification S.O. 1492(E) dated July 1, 2011, all statutory bodies
constituted or established by or under a Central Act or state Act requiring to
have their accounts compulsorily audited by the CAG were exempted from all the
provisions of FCRA 2010.
