Govt may bring in ordinance on faculty quota in colleges & univs

Teachers’ Groups Want Reversal Of HC Ruling Which Was Upheld By SC

The government is considering an ordinance to undo the Allahabad high court’s decision, upheld by the Supreme Court, ordering department-wise appointment of Scheduled Caste and Scheduled Tribe faculty in government-run and aided colleges and universities — a move that reduces the number of reserved posts.

The government’s consideration comes in the wake of SC on Wednesday upholding the HC verdict that said posts reserved for SCs and STs will not be filled by taking university or college as a unit. The University Grants Commission had issued an order after the HC ruling before the Centre challenged it in SC.

According to a senior official, the government is weighing its options amid a growing demand from teachers’ associations and political parties for either an ordinance or bill to reverse the HC’s 2017 verdict. A bill could be considered to regularise an ordinance when Parliament meets on January 31for 13 days for the budget session. These are emergent options apart from a review petition that will not be settled soon and where there is a small possibility of the SC reconsidering its ruling.
In line with the HC ruling, UGC in a March 2018 order issued new clauses requiring a department-wise roster system for all levels of teachers.

The department-wise formula drew backlash. According to the HRD ministry, the new formula brings down representation of SC/ST faculty by nearly 50%. With considerable number of faculty posts for the reserved category laying vacant, the scheme would further shrink numbers.

After SC struck the special leave petition, it is learnt that PMO stepped in and “a decision is likely in next three-four days,” a government source said. The government had in August 2018 thought of an ordinance but decided to wait for the disposal of the SLP. Teachers’ unions like the DU Teachers’ Association have written to MHRD demanding an ordinance to restore UGC’s 200-point roster, which was in place prior to the HC’s order.
